Upcoming Proposition 65 Warning Labels for BPS

 

LAWRENCEVILLE, GA, November 25, 2024 – In advance of December 29, 2024 our direct thermal products will include Proposition 65 warning labels due to the presence of Bisphenol S (BPS) in certain products.

 

What is Proposition 65?

 

California’s Proposition 65 requires businesses to provide warnings to California consumers about exposures to chemicals that can potentially cause cancer, birth defects, or other reproductive harm. BPS, which is used in the coating of some direct thermal labels, has been added to the list. Therefore, BPS is subject to the warning requirements of Prop 65 beginning on December 29, 2024.

 

How Does this Affect You?

 

To ensure compliance, we are adding the necessary warning labels to our direct thermal products that contain BPS. Even if your business operates outside of California, the end use products you distribute may ultimately be shipped or distributed to end-users within the state of California, which means your products could also be subject to the Proposition 65 labeling requirement. To re-iterate, there may be additional requirements that you may need to undertake, so please take action to understand your obligations under this regulation.

 

 

Important Notice

 

REI will not indemnify or defend for Prop 65 non-conformance. We strongly encourage all customers to take necessary action to understand any additional compliance obligations that may be required of you under this regulation, such as the need to warn the end-users at the point of purchase or any other warning requirements. REI is committed to selling products that adhere to regulatory requirements, therefore is working to ensure compliance to Prop 65, but this regulation has obligations that you may also have to follow, which are separate from actions taken by REI.

 

What Should You Do?

 

  • We encourage all customers to thoroughly review and implement any compliance measure required by this legislation, and to consult with your attorneys if you have any questions.
  • Customers who purchase product containing BPS may also need to provide warnings to consumers in the end use environment.
  • Each customer is responsible for conducting their own review and analysis of compliance requirements.
